The client acknowledges the terms and conditions below.  The validation of your order by clicking "confirm order" is a full acceptance of these terms and conditions. After clicking acceptance above, the order is considered final and cannot be questioned.

The Law

The site www.boursot.fr is based on French soil and is therefore subject to French law.  Any order automatically implies your agreement to our terms and conditions. These terms and conditions are governed by French law.

Protection of minors

The decree n° 59-107 of 7 January 1959 and the Law n° 74-631 of 5 July 1974 prohibits the offer and sale of alcoholic drinks to minors. By consequence, in completing your Order Form, you accept that you have the legal capacity to enter into this contract.

Intellectual Property

The web site of SARL Wine Consultants is an intellectual work protected by the laws of Intellectual Property. The Site and its components are the sole property of SARL Wine Consultants.

All elements of the site, including text, presentations, illustrations, photographs and layouts are, except public documents and other additional information, the exclusive property of SARL Wine Consultants. As such, representation, reproduction, hosting, distribution and redistribution, whether partial or total are prohibited. Anyone doing so without being able to prove that prior express had been given by the copyright holder is liable to the penalties for copyright infringement under the Code of Intellectual Property.

This is the same regarding the database contained on the Site. Hypertext links to the website of Wine Consultants can be made only with the prior written permission of SARL Wine Consultants. SARL  The company SARL Wine Consultants disclaims all liability for the content of websites linked to www.boursot.fr.

The Abuse of Alcohol

The abuse of alcohol is dangerous to the health. Consume with moderation.

Packaging

Given the constraints of packaging, we remind you that order units should be by carton (or case) of 6 with the exception of gift boxes or if otherwise mentioned on the site.

Satisfied or Reimbursed

If, despite the care we take to select our wines, the product that you have bought does not give you satisfaction, you can return it at our charge and in the original packaging within 7 working days following the delivery to:

The Prices

The prices of our products are expressed in Euros, with all taxes included except delivery charges.  Our prices and charges are updated periodically.

Delivery charges are at the charge of clients.

Collection is free from our shop in Ardres at 9 rue de l'Arsenal, 62610 ARDRES.  Open from 10h00 to 18h00 from Monday to Saturday.  Immediate collection is possible after payment of the order.

Delivery

Orders are delivered to the address indicated by the client. The parcel will be directed to the customer by our transporter or its agent.  On delivery, the Client is advised to check the condition of the packaging and the contents of the package, to check the quantity against the references shown on the delivery note.  All breakages, damaged or missing products must be clearly stated in writing to the carrier at the time of deliverySigning the delivery receipt assumes customer acceptance.

The free delivery is only available for France mainland only.

Delivery Times

The average delivery time for standard service is 5 working days from the receipt of the order (from Monday to Friday, orders placed before 12:00 pm). The delivery time by express service is 24-48 hours from the receipt of the order (order before 12:00 pm).

Except in cases of force majeure, the delivery time will be within the proviso of available stocks, as listed above .

These periods are exclusive of Saturdays, Sundays and French holidays. All orders will be processed from Monday to Saturday until 12:00, except on French public holidays.
For standard service, deliveries are made Monday to Friday (excluding public holidays).
For express service, deliveries are made Monday to Friday (excluding public holidays).

Delivery Delays

We will do our best to deliver your shipment within our usual delivery time. However, if the delivery time was not able to give you satisfaction, we inform you that under no circumstances can we refund the product and only the delivery cost may, subject to the reservations expressed in the preceding paragraphs, be recoverable.

Circumstances outside our control

We cannot be responsible for loss, damage, errors or failure to deliver an order once it is established that there are circumstances beyond our control.  By "circumstances beyond our control" this includes:

acts of God or force majeure, including: earthquakes, cyclones, storms, floods, wars, traffic, train and plane accidents, embargoes ...

defects or features associated with the nature of the shipment even though it would have been known to us at the time of our acceptance,

any act, default or negligence of any third party, for example, the sender, recipient, any interested third party, customs or any employee of any other administration, postal services, any carrier or other third party to whom the item would be entrusted by our carrier to serve areas not served by itself, and that, even if the sender has not requested or been informed of the use of a third party.

Similarly, we are not responsible for any damage caused by electrical or magnetic phenomena and / or erasure of, electronic or photographic images or recordings.

In case of non compliance with our commitments and for whatever reason, the company SARL Wine Consultants will be required to repay only the delivery charge under the provisions set out above (Late Delivery) and in no case any indirect damages that the customer may come to invoke.

Breakage

If a parcel arrives damaged (breakage of bottle/s), the recipient must refuse the parcel.  The transporter is obliged to inform SARL Wine Consultants. On receipt of this information, SARL Wine Consultants engages itself to send afresh an identical parcel immediately to the recipient.  In no case can the customer demand repayment of the product and package delivery.

Availability

All products are available in stock. However, given the specific and finite nature of the products offered, we may not always be able to restock from our suppliers. Our supply is therefore understood to be within the limits of available stocks

The updating of our product database is made regularly.  Nevertheless the products displayed as available can sometimes not be there at the moment of processing your order. Therefore, the client expressly discharges SARL Wine Consultants from any liability as a result of any constraints mentioned above.

Therefore, if the products ordered are available, your order will be processed within 3 working days and delivered within a period not exceeding 8 days.

If the goods ordered are not available at the time of processing your order but can be replenished, they will be sent as they come into stock.

If the goods ordered are not available in stock at the time of processing your order and cannot be restocked, we will inform you of the situation by letter, e-mail or telephone.

If there is a stock shortage, the missing item would be replaced with a product selected from our rangeof equivalent quality and price.

Images, photos and illustrations: Be aware that the visuals on www.boursot.fr are not contractual.

The Quality of Products

In no case can SARL Wine Consultants be held responsible for any degradation of quality of its products and their packaging as a result of their transport.

Delivery Address

If the package is returned to SARL Wine Consultants with the message "incomplete address" or "wrong address", SARL Wine Consultants will contact its client to inform him of the situation and to request additional information on the address or even a new delivery address. The charges of this new despatch will be at the charge of the client. Deliveries to medical care establishments (clinics, hospitals, maisons médicalisées) will not be able to be effected.

Delivery & Payment

Paying for your purchases is made either online by credit card or by bank transfer. For card payments, provisions relating to the fraudulent use of payment by credit card are applied.  For the sake of security, orders of substantial amounts of money (more than 500 in France, more than 300 in Europe), we are entitled to ask for supporting documents or re-credit the corresponding amount and ask you to make the payment by bank transfer. In all cases, the customer will be contacted and informed of this.

Secure Order

So as to optimise the security of transactions on the Internet, an online payment system (Atos Worldline) is offered to the client that encrypts all data related to your order (including your name, address and phone number and details of your credit card ) so that the information you give us is protected during transmission.

In addition, the means and cryptology services used to secure transactions have been declared and been authorised under the current legislation.

Cancellation of Your Order

Any request for cancellation of an order must be effected before the despatch of the products in order to be taken into consideration.  The minimum delay to warn us is 24 hours before the date of departure of orders. This cancellation has to be by e-mail, fax or telephone.

Reclamation

Any reclamations must reach us within 30 days of the date on which we accepted your order.  Such a reclamation must be addressed to us by "Courrier Recommandé avec accusé de réception" at the following address Wine Consultants, 9 rue de l’Arsenal, 62610 Ardres.

Responsibility

SARL Wine Consultants cannot be held liable for breach of contract, in case of a stock shortage or product unavailability, force majeure, total or partial strike, flood, fire or other natural disasters and in general all events not permiting the efficient execution of the order.

Electronic Signature

The "OK" associated with authentication and non-repudiation and protection of all messages constitutes an electronic signature. This electronic signature has the value between the parties, of a handwritten signature.

Proof

The records stored in the computer systems of SARL Wine Consultants under reasonable security conditions, will be considered proof of communications, orders and payments between the parties.

Dispute Resolution

All contractual provisions set out above shall be governed by French law. Our customer service department is available for the settlement of any dispute and failing an amicable solution, the courts alone will have jurisdiction.

Personal Information collected and your rights of access

We do not collect data, including Internet address, URL links through which the user accessed the Site, the Service Provider of the User, or Internet Protocol (IP) address.

The user, having justified his identity, may ask the SARL Wine Consultants staff for:

Verification of personal data concerning him and having been collected by SARL Wine Consultants or on its behalf

Information relating to the purposes of processing such data, identity and geographical location of the recipient of these details

The communication of a copy of the data, free of charge, provided that such a demand is not abusive, particularly through any repetitive or disproportionate character.

SARL Wine Consultants will ask users making such a request to prove their identity by sending a copy of their identity card or any other official identity document.

No personal information about the user of the Site is collected or published without the knowledge of the user or even sold to any other company.  SARL Wine Consultants is nevertheless allowed to conduct research and statistical analysis on the use and type of users of www.boursot.fr, subject to confirming the anonymity of these.
